Section 191
CHILDREN WHO CAN BE GIVEN FOR ADOPTION
The following children who have been in an orphanage for at least six months can be given up for adoption to a foreigner:-
(a) Orphaned children who are not cared for by the death of both father and mother,
(b) Voluntarily Abandoned Children.
(c) "Children's home" means children's welfare homes and orphanages established in accordance with the law for the purpose of protecting the rights and interests of children, and the term also refers to children's homes or children's temples established by the Government of Nepal.
(d) "Orphan Minor" means any of the following children who have been certified as orphans by the District Administration Office:-
(a) Being found by the police in an abandoned state and his father or mother not being found,
(b) left unattended in a hospital or health institution,
(c) Father and mother not found,
(d) Both father and mother have died and there is no property for maintenance.
(e) "Voluntarily abandoned children" shall mean the following children who have been entrusted to a children's home through the district administration office after the following person is unable to arrange for the upbringing and education of the children:-
(a) in the case of children whose father is dead or absent and whose mother has remarried, such mother, (b) If more than one child is born and the father is dead or missing or absent, and the mother is unable to support or educate such children due to financial reasons, the mother of such children,
(c) If more than one child is born and the mother is dead or absent, if the father is unable to support such children due to financial reasons, the father of such children,
(d) In the case of orphans who have no property, by guardians or mathwars.
